Hello and welcome to our tiny online shop of organic fabrics!

We are glad that you are interested in purchasing our products, but first you ("consumer") should carefully read the following, as you will be informed about the general terms and conditions ("norms") which regulate the browsing and the procedures necessary to place an order on this site (www.primrosefabrics.com).

 

You will get explanations regarding the processing of your personal data as required by art. 13 of Legislative Decree n.196/2003 - Italian Code for Data Protection, and by the EU Regulation 2016/679 (GDPR).

You should periodically check this section and the related links as they can be modified at any time and without notice. However, I will alert you of any substancial changes. At the top right of the page you can check the date of the last updated version of this document.

1. Premise

By continuing the browsing and placing an order on this website you accept and approve entirely the general terms and conditions of sale of Petite Fleur srls ("Seller") and their applications. These policies are exclusively valid for this website and not for the supply or sale of products by other vendors who appear on the same website through links, banners or other hyperlinks. 

 

2. Defence clause

Any other terms, including any terms and conditions that you may claim, but disagree with these policies, are excluded.

 

3. How to place an order

Placing an order on primrosefabrics.com is very simple and fast

1. In the Menu by clicking on the Shop page you can select the product you want, check its information and its details. You can also decide to add the desired quantity to the basket simply by clicking on the "ADD TO MY BASKET" button.

2. To see the content of your basket click on the basket icon. This will open a new tab from which you can cancel your order or proceed to the payment by clicking on the button "see my basket"

 

3. To complete your purchase you have two possibilities:

 

a. by clicking on the "CHECKOUT" button, a new tab will open. Here you will be asked to enter the data necessary for the shipping and invoicing processes, and to choose the preferred shipping and payment method. You can then proceed to finalize your purchase via paypal/credit card, or via the offline payment method through bank transfer.

Once you have verified the accuracy of your data and of the products you purchase, you must confirm that you have read the general sale conditions, the privacy policy and the refund policy. You can then place the order by clicking on the "PLACE ORDER" button.

4. Order confirmation

Once the order has been placed, an email will automatically be sent to the address you give at the time of checkout . This email simply sums up the details of your order. Only when you receive the confirmation of shipping, the purchase contract will be concluded. 

Please note

In case the bank rejected the order acceptance, Petite Fleur srls reserves the right to cancel the order you have made.

 

5. Cancelling an order

​To cancel your order please send an email as soon as possibile with your request and your order detail to hello@primrosefabrics.com

Once your order is shipped it will no longer be possible to cancel it. You can return your order within 14 days of the date of receipt of the product. For more details please see  the section 11. Returns

6. Product Availability

The availability of products refers to the current availability when you place an order. This availability should still be considered purely indicative because, due to the simultaneous presence of multiple users on the site, the products could be sold to other customers before the order is confirmed.

 

7. VAT prices and invoicing 

The prices on this website are expressed in EUR (€) and including VAT 22%.

For orders destined for non-EU countries and for EU companies with VAT number (Intrastat) transactions, the VAT is free of charge.

We will refund the VAT tax cost within 2 working days after shipping date.

We remind you that there are no customs duties within the EU and the total price paid is inclusive of any spending, unlike the extra-EU orders.

Please note

Shipping costs are not included in the prices but they are indicated separately and in some cases they may be free of charge.

Prices can vary at any moment and without notice.

 
 

8. Extra EU orders

Fabrics are shipped from Italy.

​In each non-EU country, the imported goods are subject to a customs clearance procedure.

In this case, you accept the full responsibility for the customs clearance of the goods as well as for any issues concerning their inspection or retention.

Customs services have the right to block and control the goods. As a result, Petite Fleur srls can not be held responsible for any delay imputable to the customs clearance procedure.

 

Customs duties, taxes and/or customs clearance fees (including any intermediaries where specified) may be applied for importing the goods and are to be paid by you.

Petite Fleur srls has no control over these procedures and can not make an estimate of customs duties or of charges/import duties. For no reason Petite Fleur srls will refund such expenses. In the event that the customs clearance is not successful, the customs retains the goods or returns them with additional charges for return, customs duties/charges will be deducted.

 

With regard to international shipments, Petite Fleur srls provides carriers with the documentation and information required for shipping.

Please note 

It is mandatory by law to indicate the value and nature of goods shipped outside the EU and it is not possible to state a lower value, a different content or to send it as a gift. You can get further information about the import conditions in your country by contacting the customs agency and the designated carrier's branch office to know the exact procedures.​

9. Paymet Method​s

The payment methods you can choose to purchase through include:

 

PAYPAL/CREDIT CARD (Additional costs 3.4%+0.35 EUR per transaction shall be borne by Petite Fleur)

Once you have placed your order, you will be redirected to the PayPal site where you can make and confirm your payment safely and quickly. Once the payment is registered, the order can be processed.​

 

You can use your credit card through the Paypal gateway without having to register or have an account.

Petite Fleur srls will never know your credit card details.This data is encrypted with SSL which guarantees a high level of safety and secure purchase on this site. ​

BANK TRANSFER 

Once you have placed your order you will receive an email with all the information you need to complete the payment.

Only after confirmation of credit on Petite Fleur srls's bank account in (depending on the bank, this may take up to 5 business days!) your order will be put into preparation.

You have 3 days to remit the payment on the account of Petite Fleur srls. If the payment is not completed within the set deadline, the order will be automatically canceled.

It is important to enter the order number in the payment's description to properly link the payment to the order.

This data is based on the new SEPA-/EU data transfer standards. With SEPA you can make transfers at the cost of a national bank transfer. The expenses are divided between sender and recipient and each party will take part in the expenses according to the regulations of their bank.

Please note

For orders outside the European Union, the additional costs and bank bonuses are the customer's responsibility.

 

10. Shipping and Delivery

 

We currently ship to Italy Europe,  Europe non EU, USA & Canada, Australia e New Zeland

Orders are shipped from Italy to the address you provide at the checkout within 2 business days from the received payemnt and consigned them to the express courier on the first working day available.

Please note

You must provide a valid address. If the delivery is not successful (e.g. for incorrect shipping data or due to the inability to reach the recipient even after the 2 retransmission and contact attempts) and even after the three-day storage period the shipped goods are sent back to the sender, the purchase contract will be considered resolved. As a consequence of the resolution, the payment received will be reimbursed, including any shipping costs with the exception of the those resulting from your choice of a type of delivery other than the standard shipment offered, without undue delay and in any event within 14 days from the date of withdrowal. The transport resulting from the termination of the contract may have additional costs to be paid by you. 

The delivery costs are in Eur (€) and are explicitly added to the order subtotal during chekout.

SHIPPING TO ITALY 

  • Delivery costs are Eur (€) 6,95.

  • Free delivery for orders from Eur (€) 59,90.

  • Orders are prepared within 2 business days from the received payemnt and consigned them to the express courier on the first working day available.

  • *The express courier designated for the delivery is DHL /GLS. With this service you are provided with a tracking number which you will receive by email as soon as your package is shipped.

  • Delivery time estimeted are 1- 2 days

  • *Nota bene. Nel caso in cui l'indirizzo di consegna rientri in un CAP area remota o periferica, utilizzeremo il servizio corriere di Poste Italiane. I tempi di consegna stimati saranno di 4-6 giorni. Se desideri ricevere comunque il tuo ordine tramite corriere espresso sarà previsto un supplemento di 6 euro da aggiungere alle spese di spedizione.   • The express courier designated for the delivery is DHL. With this service you are provided with a tracking number which you will receive by email as soon as your package is shipped.

  • Delivery time estimeted are 2 - 4 business days

If you decide to recive your package via ITALIAN POSTAL SERVICE

  • FREE delivery for orders from Eur (€) 99,90

  • Orders are prepared within 2 business days from the received payemnt and consigned them to the Italian Postal Office on Monday and on Friday

  • Preparation times may increase for a few days during holidays or in promotional periods. 

  • ​​Shipping is not tracked

  • Delivery time estimeted are 8 - 15 business days

  • Package that weight 2kg and over will automatically ship via express courier DHL

- PASSING OF RISK -

Once the parcel is entrusted to the courier Petite Fleur srls can neither grant delivery within the established times or the package's integrity, nor prevent theft or loss. That's why I ask you to make sure when the parcel arrives, that it is intact and it has not been tampered with. If you notice openings or believe that the package may have been damaged during shipping, sign as "unchecked" and please take pictures if possible.

In this way I will be able to help you with your refunding/replacement practices.

 

After the order is accepted, there may be cases where the delivery becomes impossible or the delivery times can not be defined for causes not imputable to Petite Fleur srls, such as prolonged strikes, adverse climatic conditions, etc. In these cases, you will be informed immediately and we will look for a mutually acceptable solution. In this particular case claims for damage compensation are excluded.

In case Petite Fleur srls is aware of such discomfort you will be notified before proceeding to the purchase process. ​

11. Returns

In accordance with the legal provisions in force (Art. 57 of Legislative Decree 206/2005) you have the right to withdraw from the purchase agreement without any penalty and without specifying the reason, within 14 days from the date of receipt of the product.  

Please note

By the nature of the products, personalised or custom-made goods can not be returned (Article 59 of L. D. 206/2005). 

If you purchased your product using a voucher or promotional code this will no longer be usable.

​​How to exercise the right of withdrawal

​1. EXCERCISE OF WITHDRAWAL

Within 14 days of the date of receipt of the product, please send your explicit statement containing the decision to withdraw from the contract entering your details, those relating to the order and purchase made and those relating to the products you wish to return, to the email address petitefleursrls@legalmail.it or via registered letter with return receipt.

2. RETURN POLICY

The product must be returned intact, unused, in the original packaging, complete in all its parts and complete with the attached tax documentation

Please note 

You may return the product not later than 14 days from the date on which you notify your intention to withdraw from the purchase contract..

The additional costs and modalities for returning the product are to be paid by you. You also take responsibility for any damage, failed delivery and delay. If you are living outside of the EU you are also required to know return policies for extra-EU returns and any possible customs duties/charges policies, which are always to be paid by you.

3. REFUND POLICY

Refunds can only have place after verifying and approving the integrity of the returned product as reported in the return policy. In this case, Petite Fleur srls will reimburse the amount of the order including any shipping costs incurred at the time of purchase within 14 days of the date of the notification of your withdrawal from the contract.

For this refund will be used the same payment method chosen in the purchase transaction, unless otherwise agreed by both parties.

Please note 

Petite Fleur srls can withhold the refund until it receives either the returned goods, or their delivery notification from the courier you chose to make the return.

In case the product does not respect the conditions of return or it is damaged, the refund will be denied.

 

12. Dettaglio prodotti

All our fabrics are printed on 100% organic cotto​n​ using low environmental impact inks.​

13. Warranty and trade compliance

Petite Fleur srls fabrics are printed using inks with low environmental impact on high quality organic cotton.

​Petite Fleur srls is responsible for any defect of the products offered on this site, including the non-correspondence of the items with the ordered products, in accordance with Italian law. If the customer has entered into the contract as a consumer (that is to say, any natural person who is acting on the website for purposes unrelated to their business or professional activity) this guarantee is valid provided that the conditions mentioned below are fulfilled.

- the defect must be found within 24 months from the date of delivery of the product; 

- the buyer presents a formal complaint about the defects within a maximum of 2 months from the date on which they found it;

- the online return form is filled in correctly (see section "right of withdrawal"). 

Please note 

In the event of non-compliance, the customer who has entered into the contract as a consumer will have the right to obtain the restoration of the conformity of the product free of charge, through repair or replacement, or to obtain an appropriate price reduction or termination of the contract with regard to the disputed goods and the consequent refund of the price.

 
 

14. Limitation of Liability

In relation to what has been previously and explicitly stated in these rules, Petite Fleur srls is not responsible for guaranteeing that the products you purchase on this site (www.primrosefabrics.com) are suitable for your purposes.

 

Contract as a consumer

Petite Fleur srls supplies the products on this site (www.primrosefabrics.com) for domestic and private use.

If you use the products for any commercial, business or re-sale purpose Petite Fleur srls will has no liability to you for any

 

- loss of profits, sales or business

 

- loss of business opportunities

 

- loss of savings

 

- indirect losses

 

In any event, the responsibility towards the consumer can not, under any circumstances, exceed the price of the products at the time of conclusion of the purchase contract.

 

15. Trattamento dei dati

The buyer's data are processed in accordance with the Personal Data Protection Act, as specified in the appropriate section containing the information pursuant to art. 13 of the June 30, 2003 L. D. (Privacy Policy).

16. Controversie

For more information about EU legislation on the settlement of disputes between customers and online shops (regolamento EU 524/2013) puoi consultare il link http://ec.europa.eu/consumers/odr/. In base all'ente scelto per arbitrare la disputa, possibili costi potrebbero essere sostenuti da entrambe le parti.

 

In particular, if the purchaser is a consumer, any disputes must be resolved by their court of domicile or residence, under the italian applicable law.
